Prosecutors to appeal ruling to set train assailant free | Prosecutors in Barcelona said Friday they would appeal a judge’s decision to release a 21-year-old man without him posting bail after he was charged with a racist attack against an Ecuadorian teenage girl.

Sergi Xavier Martín Martínez was allowed to return late Thursday after Judge Eduardo López Gómez charged him for kicking and shouting racist remarks at the 16-year old as she sat on a train. The October 7 incident, which stirred outrage throughout Latin America, was captured on tape by the train’s security cameras.

I live in the UK and although we have a fair share of so called random racist attacks, the perpertrators NEVER win, this type of behaviour is disgusting and should NOT be tolerated under any circumstances.

Bail = WTF are they thinking? Lock him up!!

This "man" who beat this girl is a coward and deserves to be sent to an ecuadorian prison to make it a fair fight.

I'm a US citizen of a Spanish family and live in New Mexico, USA. I hope that Spanish People remember that although separated by some history and an ocean we are you and you are us. My first Spanish ancestors came to Santa Fe, New Mexico in 1693 and we have lived continouously in Spain, New Mexico, and Argentina since then. Spanish people and their decendents and relatives in the new world have suffered enough with racism and many today live in oppression. Stop racisim now! The future of Spain is tied to Latin American and Hispano people and we are tied to you through culture, language, and our common history. Every day I look at the state flag of New Mexico with it's Spanish Colors, Viva Espana, Viva Latinos , Viva La Libertad!

Well that last comment just illustrates my point. I was under the impression that Spain was a progressive European country, with similar values to its developed neighbours, but you don't have to scratch the surface too deep for things to come out that you would expect from an underdeveloped or Third World state.

Do you really think that immigrants control your nation???

What you say about Africa and Latin America may well be the case, but when I last looked we were in Europe. I (and my wife) come from a country where we try to judge people as people rather than by their colour/race and by percieved perceptions. Your comment about Africa just shows how little you know doesn't it? My wife's descendants left Africa hundreds of years ago and she was born and educated in England. That makes her as European as you and I. She is ENGLISH. Why on Earth would either of us want to live in Africa, which neither of us have any connection to? Don't judge if you don't know eh? It is typically small minded to assume that anyone black must be a third world immigrant.

I'm afraid your shortsighted view is actually most dangerous to yourself. An attitude like yours leaves you wide open to fascism and what it entails (but of course ,maybe you want that?) as those people exploit your fears and predjudices stirring up hatred that will destroy you all in the end. What Spain should actually be doing is integrating its immigrants properly to become Spaniards and avoiding the mistakes of other nations rather than paying them slave wages, treating them like dirt and creating a "them and us" situation that solves nothing but creates slum cities populated with an uneducated criminal underclass.

Maybe not everybody in Spain is just thrilled to watch their country become a third-world sewer like "Latin America"? Maybe they are not thrilled to watch as every shop is bought up by Pakistanis and Chinese?
Would the Pakistanis sit by quietly if Europeans were suddenly to emigrate to Pakistan and buy up every business? Would the Chinese?
Did the "Latin Americans" like it when Spain controlled their Nations?
Of course, the answer is NO to all of the above! And, to the white guy above married to a black women: Try living in Africa and see what kind of response you get to your relationship anywhere where blacks are a majority. Then, come back and make your comment.
